The conditions set out below apply to all holidays carried out by this company. It is important that you read them as they tell you exactly what your rights and obligations are when you book a holiday with this company. When you sign a booking form on behalf of yourself and others named in your party you will confirm that you have read, understood and accepted these conditions. All correspondence should be addressed to :- Torquay Travel, 78 Avenue Road, Torquay, TQ2 5LF.
1. The Contract
When you make your holiday booking you are accepting the booking conditions on behalf of yourself and your party. These conditions form part of your contract with us and are subject to English Law and the exclusive jurisdiction of the English Courts.
2. The Holiday
Torquay Travel will endeavour to make your holiday as enjoyable as possible. All holidays are inclusive of coach transport, accommodation, selected excursions and various evening entertainment. There are times when due to circumstances beyond our control the holiday may vary from the advertised description.The company reserve the right to make changes provided that the changes are of a similar standard to the original holiday. Where any major changes are made you will be notified of these changes and given the choice of:-
a) Accepting the holiday as modified.
b) Changing to an alternative date or holiday.
c) Cancelling your holiday with 100% refund.
3. Guarantee of Price
The price of the holiday is guaranteed as advertised at the time of booking with the exception of any government increase in taxation. In the event of any taxation increases the company reserve the right to pass on the same increase.
4. The Hotel & Facilities
Please note we cannot guarantee the operation of lifts, swimming pools, leisure equipment etc. and accept no liability where they are out of use for maintenance or repair. A small charge may be payable for certain hotel facilities or leisure memberships. Various evening entertainment is provided in the hotels, the style and frequency is at the discretion of the hotel management and therefore not guaranteed, this facility could be withdrawn if there is a lack of demand or insufficient numbers in the hotel. All hotel descriptions and facilities are based on information provided by the hotels at the time of going to press. In the event of unforeseen circumstances Torquay Travel may deem it necessary to relocate the tour and thus reserve the right to use alternative, equivalent or greater standard hotel accommodation without notice.
5. Excursions & Transportation
Excursions will be carried out as per itinerary. Torquay Travel reserve the right to change excursions and transportation details as necessary, to cover drivers legal rest requirements, weather conditions, traffic problems etc.
6. Special Requests
These will be passed on to the relevant persons and provided wherever possible, however under no circumstances will they be guaranteed.
The company will not delay the departure of a coach if you arrive late at your starting point for the holiday or at any other joining point en-route. The company is not liable for any loss or expense suffered by passengers because they arrive late.
8. Deposit and Peace of Mind Guarantee
Many people worry about paying large sums of money to holiday companies sometimes as much as eight weeks prior to travel , at Torquay Travel we try to relieve this worry. A £30.00 per person deposit is required to secure the booking with the balance payable only twenty one days prior to travel. This offer is for your peace of mind. Please Note:- cancellation charges still apply as listed below.
Torquay Travel Clients Account:-
Total security for all prepayments, to comply with EEC regulations. All payments (deposits/full payments) are held in the client account until the completion of the tour.
By the client:-
Should you wish to cancel your holiday after your booking has been confirmed this must be communicated in writing to Torquay Travel.
By the company:-
Events can occur which cause the company to have to cancel the booking. In the case of these unlikely events occurring we reserve the right to withdraw the holiday and refund to you all payments made. This shall be the limit of the companies liability, however every effort will be made to find you a suitable alternative of similar or higher standard. (All tours are subject to obtaining minimum numbers)
The company shall in no circumstances be liable for any loss, damage, disappointment, additional expense, frustratic injury, death or other harm suffered by any passenger as a result of traffic delays, mechanical breakdown, change of route, accident or otherwise in the course of the holiday, caused other than by the negligence of the company.
11. Complaints Procedure
The driver/courier must be informed immediately to allow the problem to be rectified. Written complaints must be received by the company within seven days of return from your holiday. No liability will be accepted for complaints not reported to the driver nor for those received beyond the stated time limit.
12. Luggage (Torquay Travel luggage labels must be used)
Although our coaches have large luggage compartments, we have to adhere to regulations concerning overall weight of fully laden vehicles. We would therefore request that clients restrict luggage to one medium sized suitcase per person.
The company will only take responsibility for luggage clearly marked with the correct Torquay Travel luggage labels.
More than 42 days before departure - Deposit only
Within 28-42 days of departure - 50% of holiday
Within 15-27 days of departure - 60% of holiday
Within 14 days of departure - 100% of holiday
It is strongly recommended that holiday insurance is taken.
Clients will be responsible for any cancellation charges as listed above.
